 I-130 Approved, I-485 Pending and the School Asking to Register Full-Time Status

Dear Sajha users,
I applied for 130/485 concurrently this February (my spouse is a USC). we had an interview this may. I-130 was approved right on the spot but the IO asked me to provide the birth certificate. Later I mailed that and it's been 6 weeks and have not heard anything in 485 progress. When I check the USCIS website, it still shows in Testing and Interview phase.
I was going to school till February. once I applied the 485 and got the receipt, I dropped school and withdrew from the class. For the winter of 14 session, I did not take any classes. Today, I got an e-mail from my school stating that I should immediately register for 12 cr. hours or else, my SEVIS will be terminated. So, what should I tell my DSO right now?? Anyone thru similar situation?? Please share ur experiences. Any insights will be highly appreciated.

As much as possible, It is always strongly advised to maintain a valid status in the US based on my experience w/ immigration attorneys. However, in your case, I130 is approved & 485 is in progress, which will most likely be approved as well. It's a personal choice to whether take the 12 credit hours & continue maintaining status or stay out of college relying entirely on the 485 petition.

As for notifying the DSO, you can simply scan & email or mail them a copy of your approved I-130 & pend

**pending 485 petition. They will update your SEVIS accordingly & you should be fine as long as 485 is pending and/or when it gets approved.

Tell your school to f*uck off.....you are good to go..no need to go to school...ur GC is on the way......they can go ahead and terminate ur sevis which wouldn't matter at all to you.......SEVIS record is terminated anyway when u become green card holder...congratulation and good luck bro/sis
